»The Borrowing Autonomy of German >Länder< and Its Limitation« Since recently, the so-called debt brake (>Schuldenbremse<) in Article 109 III of the Basic Law of the Federal Republic of Germany has become fully applicable to the >Länder<. Yet, many of the associated legal questions are still unresolved. Against this background, the author examines the constitutionality of the debt brake as well as its effects on German federalism. He also analyses the topic in the context of legal theory and comparative law.
